The ENGAGE Toolkit User Agreement

The ENGAGE Toolkit (“Toolkit”) website and content are licensed to you (“Licensee”) by Project ENGAGE under these terms and conditions and the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0).

The ENGAGE Toolkit provides information and resources for consent to precision medicine research.

The materials contained in the Toolkit, or parts of, may be reproduced without prior permission provided the citation below is listed. The citation is not required if the materials are adapted to Licensee’s research project when used in participant-facing research project materials.

Citation: We require mention and citation of The ENGAGE Toolkit in grant proposals, IRB applications, presentations, published manuscripts, and other reporting. Required citation:

Site Agreement: Creating tailored consent materials on The ENGAGE Toolkit website indicates Licensee’s agreement to be included as a “Collaborating Institution” on the ENGAGE Toolkit website and within related marketing materials and reports. “Collaborating Institution” is defined as any site at which the ENGAGE Toolkit has been implemented, regardless of the number of actual individual unique users.

Data Use and Privacy: The ENGAGE Toolkit authors may access a Collaborating Institution’s user information to operate, maintain, and improve The ENGAGE Toolkit. User data and/or statistics may be used for scholarly purposes and conducting research. When necessary or appropriate, Collaborating Institution and/or user information may be shared to comply with applicable laws and/or to comply with lawful requests and legal process, including responses to requests from public and government authorities.

The ENGAGE Toolkit reserves the right, at its sole discretion, to terminate account access and use of its services to any Collaborating Institution, any affiliates of a Collaborating Institution, or to any users, for failure to follow the terms and conditions described in these Terms of Service.

The license granted in this Agreement is provided “as is” and without WARRANTY OF MERCHANTABILITY or WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE or any other warranty, express or implied. Project ENGAGE, Columbia University, and Syracuse University make no representation or warranty that the use of Toolkit or materials will not infringe any proprietary rights of a third party.

Under no circumstances shall Project ENGAGE, Syracuse University or Columbia University be liable to Licensee or any third party for direct or indirect damages of any character, including, without limitation, loss of profits, loss of use, loss of goodwill, computer failure or malfunction, even if advised of the possibility of such damages. Licensee agrees to hold Project ENGAGE, Syracuse University and Columbia University harmless for any and all liability Project ENGAGE, Syracuse University or Columbia University may incur as a result of Licensee’s use of the Toolkit.

Licensee understands and accepts that Project ENGAGE, Columbia University, and Syracuse University are under no obligation to provide maintenance or support services, notices of latent defects, or correction of defects for the Toolkit.
